MHElevation Forklift Driver Training Terms & Conditions of Booking

MH Elevation provides professional, accredited forklift and workplace equipment training delivered onsite at your premises. These Terms & Conditions outline the responsibilities of both MH Elevation and the Client, ensuring all training is delivered safely, professionally, and in accordance with recognised industry standards.

By booking training with MHElevation, you accept these terms and conditions.


1. Insurance Requirements

If MHElevation provides an instructor at the Client’s premises, the Client must have insurance that covers employer liability and third-party risks related to the training.


2. Training Facilities & Authorisation

Where MHElevation arranges for an instructor to deliver training on the Clients premises, it is the client’s responsibility to ensure that they have the correct facilities available.

By accepting our terms and conditions you are giving MHElevation authorisation for the instructor and candidates to operate the truck type for the duration of the training.

If necessary, the instructor may request that the Client provide eligibility documentation to confirm the candidate’s right to attend the course.


3. Conduct of Candidates

MHElevation may deny or expel candidates from courses for inappropriate behaviour. The instructor’s words are final.


4. Medical Conditions

Inform MHElevation in writing of any medical condition that could affect you or others (e.g., epilepsy, diabetes). MHElevation will keep such information in confidence.

For courses that include physical activity, candidates are responsible for obtaining medical advice to confirm their suitability to participate.


5. Language Requirements

All delegates are expected to have a sufficient understanding of both spoken and written English to participate effectively in the training.

While MHElevation will make every reasonable effort to support trainees who experience difficulty with the language, it is the responsibility of the Client to provide an interpreter at their own expense in cases where a delegate requires assistance.

If an interpreter is not provided and the delegate is unable to engage fully with the training, MHElevation reserves the right to decline to train the delegate. In such cases, the Client will still be charged according to the terms of the booking.

The instructor’s decision in these matters is final.


6. Client Responsibility & Equipment

The Client will accept full responsibility for all statutory requirements placed upon a Client by the relevant governing bodies and the Acts including the maintenance and safety of vehicles, plant, lifting equipment, protective clothing and all applicable insurances including any loss, injury or damage sustained during the course or training, or arising out of neglect and/or breach of statutory duty by the Client or any other way.

It is the Clients’ responsibility to ensure that the training facilities, equipment, and conditions are appropriate to the training provision.


7. Training Delivery, Fees & Liability

MHElevation and /or designated company representatives reserves the right to abandon/ discontinue or re-arrange the provision of training where such circumstances prevail that would affect the quality of the training provided. This includes the provision of faulty equipment and plant without relevant test certificates.

In the event of cancellations/reorganisation, the Client is responsible for the cost incurred.

All fees quoted are exclusive of VAT. All fees are payable within 21 days of the invoice date and shall thereafter be subject to the provisions of the Commercial Debts (Late payment invoices) Regulations 1998.

Certificates and course reports are issued upon payment in full.

MHElevation accepts no liability for the loss caused by its own negligence. Liability is limited to the contract value; MHElevation is not responsible for additional or consequential loss.


8. Cancellations

MHElevation reserves the right to apply the following charge:

For cancellations made up to 14 working days before the course start date, 10% of the course fee
For cancellations made 14 working days or less before the course date, 50% of the fee
For 7 working days or less before the course date the full fee will be charged

All cancellations require written notice; your cancellation date is when MHElevation receives it, and charges apply based on that date.

Substitutions are permitted prior to the start of the course.


9. Certification

Certification will be issued once full payment has been received.

The cost of replacement certificates stands at £10.00.


10. Variation of Terms

These terms and conditions of business may only be varied by express agreement in writing by both the client and MHElevation Instructor.
